TERMS & CONDITIONS ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS & CONDITIONS The use of this Web site constitutes acceptance of the Gear Sniper Store.com’s Terms & Conditions. You accept and agree to be bound by the Terms & Conditions, operating rules and/or policies of Gear Sniper Store.com, published by Gear Sniper Store.com as described below (all such Terms & Conditions, operating rules and/or policies as they may be amended from time to time shall hereinafter be referred to as these "Terms & Conditions"). Members may be referred to as "Member," "User," "Buyer" when a Member is being described as acting as a buyer in a Gear Sniper Store.com transaction, "Bidder" when a member is being described as bidding on an item in order to act as a potential buyer in a Gear Sniper Store.com transaction, and "Seller" when a member is acting as a seller in a Gear Sniper Store.com transaction. These Terms & Conditions comprise the entire agreement between member and Gear Sniper Store.com and supersede all prior agreements between the parties, regarding the subject matter contained herein. Gear Sniper Store.com acts as a website for sellers to list items and buyers to bid on or buy fixed items. Gear Sniper Store.com is NOT involved in the actual transactions between buyers and sellers and assumes no responsibility for actions made based on information or services. In the event that any parties using our site, including sellers, buyers and bidders, have a dispute, the company (including our officers, directors, agents, affiliates, and employees) is not liable for any claims, demands and damages arising out of or in any way connected with such disputes. If any dispute is made with Gearsniperstore.com, all matters will be settled under MN state laws.
Bidders/Buyers must register with Gear Sniper Store.com as a member and be capable of forming legally binding relations under applicable law. The services provided by Gear Sniper Store.com are not available to individuals under the age of 18 years old and any other individuals who are legally prohibited from, or otherwise incapable of, entering into binding contracts. SELLERS Sellers must be the rightful owners or authorized by the owners of such items, a court of law, or through power of attorney(s) to sell that item. Sellers must be able to produce evidence of ownership and/or authorization to sell an asset upon request of Gear Sniper Store.com. Sellers must determine method in which payment will be accepted for that item. Payments can be accepted with methods under the sellers choice. Examples include, but not limited to Sellers Paypal account, Money Order, or Checks. The settlement of a purchase and sale of an item following a completed bidding or fixed priced listing process shall be conducted pursuant to this section, unless otherwise provided in the seller's conditions of sale or in a written agreement executed by the buyer and seller. Unless otherwise provided in the seller's conditions of sale or otherwise agreed upon by the seller and buyer in writing, final settlement shall take place no later than five (5) business days after buyer is given a winning notice.
All Sales Are Final Once a party becomes a member of the site, the member will select a user name and a password. Members are entirely responsible for maintaining the confidentiality of their user names and passwords. Furthermore, members are entirely responsible for any and all activities, which occur under a member's user ID and password. Member agrees to immediately notify Gear Sniper Store.com of any unauthorized use of Member's ID or any other breach of security known to Member. CONDITIONS OF PURCHASE AND SALE All purchases and sales of items and use of the site shall be conducted in compliance with applicable law. Purchases made on the site are entirely without recourse to Gear Sniper Store.com. All members acknowledge and agree that closing of all sales of items may be subject to final approval of a court or other agency and that if such approval is not obtained. PAYMENTS PayPal- This is what Sellers use to Receive Payments via Credit Cards. This expands the method of payment used by the buyer. As a buyer, you do NOT have to have a PayPal account to use your credit card to purchase an item. Click the "pay with PayPal" button in the checkout page when purchasing an item and click 'continue' under the "Don't have a PayPal account?" section. From there you may securely enter your information to finish purchasing the item. FIREARMS The purchase and sale of firearms and ammunition, other than muzzleloaders/primitive weapons, is strictly prohibited on Gear Sniper Store.com. Any attempt to do so will result in termination of membership and individuals will be subject to any/all consequences of the law. PAYMENT TO GEARSNIPERSTORE.COM Payments can be made to Gear Sniper Store.com after each listing, or sale of items. Sellers are not penalized for early settling of payments. Sellers must pay outstanding balances to Gear Sniper Store.com at minimum, on a monthly basis. Payments can be made through PayPal to payments@gearsniperstore.com or checks can be sent to the address provided in the 'Billing Details' under 'My Account' tab. Failure to pay outstanding balances to Gear Sniper Store.com will result in termination of membership and all rights on Gear Sniper Store.com. Gear Sniper Store.com will partner with collection agencies to ensure all payments are subsequently paid in full. 2010 Texas Hunt Contest Details Every item you post to SELL puts you in a drawing to win a FREE Texas Deer Hunt in 2010!! When a user posts an item to sell on Gear Sniper Store.com, it will generate a ticket that will be entered in a drawing for the chance to win a FREE Texas Deer Hunt! The MORE postings, the BETTER your chance will be to win!! Dates for the 2010 trip will be confirmed with the prize winner. Only the cost of the hunt will be covered in the prize. Travel to and from, trophy care and transport, hunting gear will be the responsibility of the winner. GearSniperStore.com reserves the right to change details of the drawing at any time. |
